1. Introduction

The following statement is in accordance with the Protection of Personal Information Act, 2013 ("POPIA") and is intended to govern your interactions and business dealings with iFox Host (Pty) Ltd.

In this statement, "Third Parties" include but are not limited to; operators, shareholders, subsidiaries, affiliated companies, joint ventures, suppliers, and parties providing products, goods, equipment, systems, and services such as information technology.

"Personal Information" means any information or set of information that identifies a person and is processed by or on behalf of iFox Host, as described in Chapter 1, Section 1 of POPIA.

2. Processing of Customer Personal Information

iFox Host may only process customer Personal Information on its systems in accordance with POPIA, insofar as it is given consent by customers; is necessary to carry out actions for the conclusion or performance of a contract to which the customer is a party; is part of an obligation imposed by law on iFox Host; protects a legitimate interest of a customer; or is necessary for pursuing the legitimate interests of iFox Host or a Third Party to whom the information is supplied.

3. Distribution of Personal Information to Third Parties

iFox Host may provide access to or transfer Personal Information to Third Parties where it is necessary for the purpose of conducting its business activities with customers, in line with its terms and conditions, or as required by law.

iFox Host undertakes to take reasonable and practicable steps to ensure that customer Personal Information transferred to Third Parties is handled confidentially and in accordance with applicable legal requirements.

iFox Host shall only transfer Personal Information to Third Parties in other jurisdictions where such Third Parties comply with laws, policies, or agreements regarding privacy, data protection, and confidentiality, as legally required.

iFox Host may disclose customers’ Personal Information to any Third Party service providers whose services or products customers elect to use, provided that it has obtained the necessary consent, it is required for the conclusion and/or performance of a contract, or there is another justification for disclosure. iFox Host will have agreements in place to ensure that Third Parties comply with confidentiality and privacy obligations.

iFox Host aims to have agreements with relevant Third Parties to ensure a mutual understanding of Personal Information protection, requiring compliance with the same or substantially similar regulations as applicable to iFox Host.

4. Receiving Personal Information as a Third Party

During the course of conducting its business as a hosting service provider, iFox Host will collect Personal Information from customers and Third Parties. iFox Host will process the Personal Information received from customers on behalf of their data subjects in line with its terms and conditions and legislative requirements.

iFox Host will ensure that, in processing or storing Personal Information as a hosting service provider, it adheres to its obligations under POPIA.

As a Third Party, iFox Host will comply with all obligations as prescribed under POPIA.
